WorldsCommons ("WorldsCommons," "we," "us," or "our") respects the intellectual property rights of others and expects its users to do the same. It is our policy, in appropriate circumstances and at our discretion, to disable and/or terminate the accounts of users who repeatedly infringe the copyrights or other intellectual property rights of others.
This policy outlines the procedure for addressing claims of copyright infringement pursuant to the Digital Millennium Copyright Act ("DMCA"). If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Service, please notify WorldsCommons' designated Copyright Agent as set forth below.
1. Procedure for Reporting Copyright Infringement (DMCA Notice)
To be effective, the notification must be in writing and include the following information (See 17 U.S.C. § 512(c)(3) for details):

A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site.

Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit WorldsCommons to locate the material (e.g., the URL of the page(s) containing the allegedly infringing material).

Information reasonably sufficient to permit WorldsCommons to contact you, such as an address, telephone number, and, if available, an electronic mail address.

A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.

A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Please note: Under Section 512(f) of the DMCA, any person who knowingly materially misrepresents that material or activity is infringing may be subject to liability for damages. Do not make false claims!

3. Upon Receipt of a Valid DMCA Notice
Upon receipt of a compliant DMCA notice, WorldsCommons will:

Expeditiously remove or disable access to the material that is claimed to be infringing.

Notify the user who posted the material ("Affected User") that we have removed or disabled access to the material.

Take reasonable steps to promptly notify the Affected User using the contact information on file.
4. Counter-Notification Procedure
If the Affected User believes that the material that was removed or to which access was disabled is not infringing, or that they have the authorization from the copyright owner, the copyright owner's agent, or pursuant to the law, to post and use the material, the Affected User may send a counter-notice containing the following information to the Copyright Agent:

The Affected User's physical or electronic signature.

Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.

A statement under penalty of perjury that the Affected User has a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.

The Affected User's name, address, telephone number, and email address, and a statement that the Affected User consents to the jurisdiction of the Federal District Court for the judicial district in which the address is located (or the 5th District of Florida if the Affected User's address is outside of the United States), and that the Affected User will accept service of process from the person who provided the original DMCA notification or an agent of such person.
5. Upon Receipt of a Valid Counter-Notice
If a valid counter-notice is received by the Copyright Agent, WorldsCommons may send a copy of the counter-notice to the original complaining party informing that person that it may replace the removed material or cease disabling it in 10 business days. Unless the copyright owner files an action seeking a court order against the Affected User, the removed material may be replaced, or access to it restored, in 10 to 14 business days or more after receipt of the counter-notice, at WorldsCommons' sole discretion.
6. Repeat Infringer Policy
In accordance with the DMCA and other applicable law, WorldsCommons has adopted a policy of terminating, in appropriate circumstances and at WorldsCommons' sole discretion, users who are deemed to be repeat infringers. WorldsCommons may also at its sole discretion limit access to the Service and/or terminate the accounts of any users who infringe any intellectual property rights of others, whether or not there is any repeat infringement.
