WorldsCommons provides an online social networking platform and community hub, including features like user profiles, activity feeds, groups, forums, messaging, content sharing, and potentially a marketplace (the "Service"), designed for creators, builders, explorers, and enthusiasts of Meta Horizon Worlds.

These Terms of Service ("Terms") govern your access to and use of the WorldsCommons website, applications, and services. • Harvest or collect email addresses or other contact information of other users from the Service for sending unsolicited emails or other commercial purposes.

• Attempt to gain unauthorized access to the Service, other user accounts, or computer systems or networks connected to the Service.

• Use the Service in any manner that could interfere with, disrupt, negatively affect, or inhibit other users from fully enjoying the Service, or that could damage, disable, overburden, or impair the functioning of the Service.

• Engage in spamming, phishing, or distributing unwanted promotional or commercial content.

We reserve the right, but are not obligated, to monitor user activity and content, and to remove or disable access to any content or terminate accounts for violations of these Terms or for any other reason at our sole discretion.

4. User-Generated Content (UGC)

You retain ownership of the intellectual property rights in the content you create and post on WorldsCommons ("User Content"), such as text, photos, videos, code snippets, 3D model files, world descriptions, etc., subject to the license granted below.

By submitting, posting, or displaying User Content on or through the Service, you grant WorldsCommons a non-exclusive, royalty-free, worldwide, sublicensable, perpetual license to use, host, store, reproduce, modify, adapt (e.g., for technical purposes like formatting for display), publish, publicly perform, publicly display, distribute, and create derivative works of your User Content solely for the purposes of operating, providing, promoting, and improving the Service. This license continues even if you stop using our Services, primarily for operational necessities (e.g., cached copies, backups).

You represent and warrant that:

• You own or have the necessary licenses, rights, consents, and permissions to publish the User Content you submit.

• Your User Content does not violate the privacy rights, publicity rights, copyrights, contract rights, or any other rights of any person or entity.

• Your User Content complies with these Terms and all applicable laws.

We take no responsibility and assume no liability for any User Content posted, stored, or uploaded by you or any third party, or for any loss or damage thereto.

5. Marketplace (If Applicable)

WorldsCommons may include features allowing users to list, sell, and purchase digital goods related to Meta Horizon Worlds (e.g., assets, scripts, templates) ("Marketplace Items").

• Role of WorldsCommons: WorldsCommons provides the platform for these transactions but is not directly involved in the transaction between buyers and sellers, unless explicitly stated. We do not guarantee the quality, safety, legality, or functionality of Marketplace Items.

• Sellers: If you list Marketplace Items, you represent and warrant that you have the full right and authority to sell such items, that the descriptions are accurate, and that the items do not infringe on any third-party rights or violate any laws. You are responsible for delivering the items as described upon purchase.

• Buyers: You are responsible for reading the full item description before making a purchase. Purchases are typically final unless otherwise specified by the seller or required by law.

• Transactions: Payments may be processed through third-party payment processors. You agree to abide by the terms of service of any such processor. WorldsCommons may charge fees or commissions on transactions, which will be disclosed.

• Disputes: Disputes between buyers and sellers regarding Marketplace Items should be resolved directly between the parties. WorldsCommons may, but is not obligated to, provide dispute resolution assistance.

• Disclaimer: WorldsCommons expressly disclaims all liability related to any Marketplace Items or transactions conducted through the Service.

6. Intellectual Property Rights

• Our IP: The Service itself, including its "look and feel," features, functionality, code, logos, trademarks, and all related intellectual property, are owned by WorldsCommons or its licensors and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our Service or included software.

• Your Content: As stated in Section 4, you retain ownership of your User Content.

• Third-Party IP: We respect the intellectual property of others. WorldsCommons is not affiliated with, endorsed by, or sponsored by Meta Platforms, Inc. Meta Horizon Worlds and related marks are trademarks of Meta Platforms, Inc.

• Copyright Infringement (DMCA): If you believe that your copyrighted work has been copied in a way that constitutes copyright infringement and is accessible via the Service, please notify our designated copyright agent according to our Copyright & DMCA Policy.

WORLDSCOMMONS DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS. WE DO NOT GUARANTEE THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY CONTENT AVAILABLE THROUGH THE SERVICE, INCLUDING USER CONTENT AND MARKETPLACE ITEMS. YOU USE THE SERVICE AT YOUR OWN RISK.

TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL WORLDSCOMMONS, ITS AFFILIATES, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE SERVICE; (B) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE SERVICE, INCLUDING WITHOUT LIMITATION, ANY DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES; (C) ANY CONTENT OBTAINED FROM THE SERVICE, INCLUDING MARKETPLACE ITEMS; OR (D) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT.

IN NO EVENT SHALL THE AGGREGATE LIABILITY OF WORLDSCOMMONS EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (USD $100.00) OR THE AMOUNT YOU PAID WORLDSCOMMONS, IF ANY, IN THE PAST SIX MONTHS FOR THE SERVICES GIVING RISE TO THE CLAIM.

9. Indemnification

You agree to defend, indemnify, and hold harmless WorldsCommons, its affiliates, licensors, and service providers, and its and their respective officers, directors, employees, contractors, agents, licensors, suppliers, successors, and assigns from and against any claims, liabilities, damages, judgments, awards, losses, costs, expenses, or fees (including reasonable attorneys' fees) arising out of or relating to your violation of these Terms or your use of the Service, including, but not limited to, your User Content, any use of the Service's content, services, and products other than as expressly authorized in these Terms, or your use of any information obtained from the Service.

10. Third-Party Links & Services

The Service may contain links to third-party websites or services (including Meta Horizon Worlds) that are not owned or controlled by WorldsCommons. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services. You acknowledge and agree that WorldsCommons shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of or reliance on any such content, goods, or services available on or through any such websites or services. Your use of Meta Horizon Worlds is governed solely by Meta's terms and policies.

11. Termination

We may terminate or suspend your access to all or part of the Service at any time, with or without notice, for any reason, including, without limitation, if you breach these Terms. Upon termination, your right to use the Service will immediately cease. All provisions of these Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

12. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Florida and the United States, without regard to its conflict of law principles.

You agree that any legal suit, action, or proceeding arising out of, or related to, these Terms or the Service shall be instituted exclusively in the federal courts of the United States or the courts of Florida located in Marion County.

13. Miscellaneous

• Entire Agreement: These Terms and our Privacy Policy constitute the sole and entire agreement between you and WorldsCommons regarding the Service and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral.

• Severability: If any provision of these Terms is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms will continue in full force and effect.

• No Waiver: No waiver by WorldsCommons of any term or condition set out in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of WorldsCommons to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.

• Assignment: You may not assign your rights or obligations under these Terms without our prior written consent. We may assign our rights and obligations under these Terms freely.
